California's Department of Consumer Affairs has prepared an informational
booklet to help guide renters through the rental process. You may download

renters. This book provides valuable information to both the renter and
the landlord regarding their rights and responsibilities. Please

California's rental housing industry is regulated as follows:
- General rental codes can be found in the California Civil Code.
Most of the codes are included in
Sections 1940 - 1954.1. These codes relate to habitability,
tenancy, termination of tenancy, and other landlord - tenant related
matters. These laws govern both the landlord and the tenant and are
adjudicated by the Superior Court (civil and small claims divisions).
- Public agencies including your Fire Department, the Building Department
and the Health Department have public safety authority over rental housing.
They are regulated by the
California Code of Regulations, and numerous statutes related to the
rental industry are contained in this body of code.
- Fair Housing laws are embodied in the U.S. Fair Housing Act, the
California Fair Employment and Housing Act, and with the California Unruh
Civil Rights Act. These bodies of law are regulated by the
U.S. Housing and Urban
Development and by the
California Department of Fair Employment and Housing.
